Terms Of Service

These terms and conditions apply to the Foodimal app (hereby referred to as "Application") for mobile devices that was created by Monolithic Innovations Pty Ltd (hereby referred to as "Service Provider") as a Freemium service.


Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.


Eligibility


You must be at least 13 years of age to create an account and use the Application. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.


In-App Purchases & Subscriptions


The Application is free to use, but may offer enhanced functionality through optional paid services, such as one-time purchases or auto-renewing subscriptions ("In-App Purchases").

  1. Payment Processing: All In-App Purchases are processed securely through the application platform on which you downloaded the Application (e.g., the Apple App Store or Google Play Store) and are subject to their respective terms and conditions. The Service Provider does not directly process your payments.

  2. Auto-Renewal: Subscriptions will automatically renew for the same duration and price unless you cancel them prior to the end of the current subscription period. You will be charged for the renewal within 24 hours prior to the end of the current period.

  3. Cancellation: You must cancel your subscription through your device's account settings (e.g., Apple App Store or Google Play Store settings). Uninstalling the Application will not automatically cancel your subscription. If you do not cancel your subscription, you will continue to be charged.

  4. Refunds: Except when required by law, all In-App Purchases are final and non-refundable. Any refund requests or billing inquiries must be directed to the respective application platform (Apple or Google), as the Service Provider does not have the ability to process refunds.

  5. Price Changes: The Service Provider reserves the right to modify subscription fees at any time. We will provide you with reasonable prior notice of any price changes. Your continued use of the subscription after the price change becomes effective constitutes your agreement to pay the modified subscription fee.


User Conduct and Prohibited Activities


You agree to use the Application only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable local, state, national, or international law or regulation.

  • Harass, abuse, insult, harm, defame, or discriminate against others.

  • Submit false or misleading information.

  • Upload or transmit viruses, worms, or any other type of malicious code that will or may be used to affect the functionality or operation of the Application.

  • Attempt to gain unauthorised access to the Application, its servers, or any connected database.

  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

  • Use the Application for any commercial purpose without our prior written consent.


We reserve the right to terminate your use of the Application for violating any of the prohibited uses.


The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. Your use of the Application is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. You can review our Privacy Policy at foodimal.app/privacy. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.


If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, the Service Provider assumes that you have obtained permission from the bill payer.


Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.


Disclaimer of Warranties and Limitation of Liability


The Application is provided to you "AS IS" and "AS AVAILABLE", with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Service Provider expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.


The Service Provider does not warrant that the Application will meet your requirements, be uninterrupted, secure, or error-free. You acknowledge that the Service Provider relies on third-party information and services (including from Expo and RevenueCat) and makes no guarantee as to the accuracy, completeness, or timeliness of any information provided within the Application.


To the fullest extent permitted by law, in no event will the Service Provider be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Application.


The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time. While the Service Provider will endeavor to provide notice of termination where possible, it is not obligated to do so. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.


Governing Law & Dispute Resolution


These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of South Australia, Australia. You irrevocably agree that the courts of South Australia shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.


Changes to These Terms and Conditions


The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
